Illinois Jury Awards $7.1M to Cooking Spray Burn Victim

Article 0 Comments CHICAGO (AP) – A jury in Illinois has ordered Chicago-based Conagra Brands to pay $7.1 million to a Pennsylvania woman who was badly injured in 2017 when a can of commercial brand cooking spray ignited in a kitchen at her workplace and set her aflame. The verdict, issued Monday in favor of Tammy Reese of Shippensburg, Pennsylvania, is the first of numerous other cases from burn victims across the country with similar stories citing accidents that occurred with Conagra-made cooking spray brands, including its popular grocery store brand Pam. Reese was working at a social club kitchen in May 2017 when “suddenly and without warning” a can of Swell cooking spray “exploded into a fireball, causing burns and injuries,” according to a lawsuit filed on her behalf. She suffered deep second-degree burns on her head, face, arms and hands, and scar tissue continues to constrict her movement six years later, according to one of her lawyers, Craig Smith. Chicago-based Conagra Brands must pay out $3.1 million in compensatory damages and $4 million in punitive damages to Reese, according to the Cook County Circuit Court verdict. Conagra Brands is the parent company of Pam and many other high-profile...

Ohio Law Applies in Insurance Dispute over Superfund Remediation Costs, Court Rules

Article 0 Comments Ohio law must be used to resolve an insurance dispute involving a polluted site in Michigan caused by manufacturing companies based in Ohio and Indiana, the Ohio Supreme Court ruled Wednesday. The 5-2 decision may force Travelers to turn over documents related to the claim requested by its insured, Scott Fetzer Co. after the federal government ordered the company to remediate hazardous waste sites. The insurer argued that the information was protected by attorney-client privilege, but under Ohio law that privilege does not shield documents in a bad faith action. A majority opinion written by Justice Jennifer Brunner said that a bad faith claim against an insurer is a tort lawsuit. In tort lawsuits, courts use the law from the state where the “most significant relationship” between the parties exists, which in this case was Ohio. Chief Justice Sharon L. Kennedy and Justice R. Patrick DeWine dissented. They said that an insurer bad-faith claim is a contract dispute, so the law of the state that was the principal location of the insured risk should be applied. As it happens, the state of Michigan — where the pollution occurred — does not recognize bad faith as a cause...

Louisiana Courts Still Tidying Up After Storm of McClenny Moseley Lawsuits

Article 0 Comments In December 2022, before much was known about how McClenny Moseley & Associates in Houston was able to set up shop in New Orleans and sign-up thousands of Louisiana clients in less than a year, US District Court Judge James D. Cain shared some strong words with the law firm’s managing attorney in Louisiana. “What I’m trying to get you to understand is you have dumped a mess on this court,” Cain told R. William Huye, who had opened up MMA’s New Orleans office in 2021. Cain and other Louisiana judges are still trying to clean up that mess. The 3,267 hurricane-damage lawsuits that MMA filed in Louisiana federal courts forced another wave of litigation, one that spawned lawsuits in both Louisiana and Texas that involve litigation finance investors, mortgage companies, damage estimators and property owners. Investors who reportedly loaned the law firm $30 million sued to get their money back. MMA sued 20 mortgage companies that refuse to endorse $20 million in insurer settlement checks. Law firms that took over MMA’s cases filed lawsuits to keep MMA from interfering with their work. Property owners sued because MMA’s lawyers told insurers that it represented them and filed...

10 Things to Know About the ACA Exchange System

What You Need to Know The open enrollment period started Wednesday in most of the country. The Affordable Care Act open enrollment period for 2024 coverage started Wednesday in most of the country without much of a fuss. The ACA public health insurance exchange system turns 10 this year, and insurers, agents and consumers all seem to know what to do. Although the enrollment period launch was quiet, the Google Trends search tool shows that search activity for “HealthCare.gov” during the week ending Oct. 28 was 40% higher than in the comparable week in 2022. George Kalogeropoulos, CEO of HealthSherpa, an ACA exchange plan sales support firm, said in a LinkedIn post that the firm is already averaging three enrollments per second. The history: Congress created the ACA exchange system in an effort to help people use federal premium tax credit subsidies to shop for high-quality commercial health coverage through a system resembling a Travelocity for health insurance. Thee exchange programs have a limited enrollment period to try to prod younger, healthy people to sign up and pay for coverage even when they feel healthy, by raising the possibility that they could be shut out of buying coverage if they...

Auto Insurers Manage Customer Expectations as Repair Cycle Times Double in Two Years: J.D. Power

Amica Mutual Ranks Highest for Second Consecutive Year: J.D. Power 2023 U.S. Auto Claims Satisfaction Study Troy, MI (Oct. 26, 2023) – Long repair shop backlogs and lingering parts shortages have caused the average auto insurance repair cycle time to reach 23.1 days in 2023, up 6.2 days from 2022 and more than double the average repair time in 2021. According to the J.D. Power 2023 U.S. Auto Claims Satisfaction StudySM, that long delay has not adversely affected customer satisfaction. Surprisingly, customer satisfaction with the auto insurance claims process improves this year, thanks to concerted efforts by insurers to carefully manage customer expectations. “It’s really a testament to strong client management processes and improved digital communications,” said Mark Garrett, director of global insurance intelligence at J.D. Power. “Insurers have been able to earn significantly higher auto claim satisfaction scores at a time when costs and rates are rising—even though it’s never taken longer to get a vehicle repaired. Notable, too, is that insurers that have improved the most in overall satisfaction have done so in two key customer areas: showing concern for their situation at the beginning of the process and keeping them informed. Being empathetic toward the customer situation...

World’s First All-Speed Crash Detection, Including ZeroMotion, by Sfara

Hoboken, NJ (Oct. 26, 2023) – Sfara is pleased to announce the world’s first all-speed crash detection, from zero motion to high speeds, capturing the additional 70% of automobile crashes that other solutions miss. Sfara’s smartphone-based crash detection covers users through the full range of driving conditions, including under 25mph and when a vehicle is not moving. Other solutions either miss or don’t report these incidents because they are unable to reliably perform. This means Sfara’s technology is the only solution on the market that detects the additional 70% of incidents others miss, and works quickly and accurately enough to support programs for both First-Notice-of-Loss (FNOL) and emergency response. Despite conventional thinking, collisions that occur below 25mph are vitally important, given the injuries and the property damages that occur. Government and industry statistics present a startling picture of what occurs on roadways that the others miss. Injury and Damage Facts What occurs under 25mph:     70% of crashes     48% of crashes with injury     22% of crashes with fatalities     20% of crashes occur in parking lots Non-moving vehicle (injury and damage facts)     27% of crashes with injury occur when a vehicle is not moving     11% of crashes with fatalities occur when a...
