Received my offer after 9 months, I was the passenger, we were rear-ended and I suffered whiplash, is this offer fair?
I live in Oregon and my mother lives in California, I had a daughter due to be born that my mother wanted to be present for, due to her age and emotional state (my father passed away last year) I decided to fly down and accompany her as she drove up from California to Oregon (through Nevada so she could see Vegas). As we were passing through Reno at a stop light, an elderly woman not paying attention rear-ended us, destroying my mothers bumper and causing me whiplash. I immediately went to the ER where this was diagnosed.
Since the due-date of my daughter was soon, I was the only income for our family (me, my wife, our son) and since the wreck, I was unable to work for a week. This put us in a very uncomfortable financial situation. I also attended physical therapy for three months for my neck since the soft tissue was swollen and kept me from sleeping comfortably.
Once my daughter was born my pain and suffering increased since I was already recovering from the whiplash, but now my sleep was very compromised by our new baby, attributing to our living environment becoming extremely stressful for everybody.
I was unable to pay the hospital bills in full, and they were quick to put them into collections, compromising my credit. ( I have paid these off since)
Physical therapy ended in January 2018 since I could no longer miss work to attended (my work hours and PT office hours were identical), and since I was fighting to catch up financially, I felt this was the best move.
I relocated to NY for work, and right before I was about to see my new PCP, the insurance agent called me to offer $7000 as the settlement. I find this to be very low in the overall cost of it all.
Key points:
The woman who hit us tried to keep us from calling the cops or contacting insurance because she didn’t want to lose her license (she was 85), she died two days after the accident.
My mother was slightly injured in the wreck and has her own claim, un-attached to mine, they offered her $350.
This wreck attributed to relocating to NY because the pay is higher had I not been financially affected as much as I was by this wreck, I most likely would not have taken this offer since this environment is far more stressful than the life we had in Oregon.
I sincerely still feel I have sleeping issues and neck stiffness in the affected areas.
Advice moving forward?
