{"id":6895,"date":"2018-04-24T00:28:15","date_gmt":"2018-04-24T04:28:15","guid":{"rendered":"http:\/\/business.financialpost.com\/?p=1579849"},"modified":"2018-04-24T00:28:15","modified_gmt":"2018-04-24T04:28:15","slug":"minnesota-judge-pushes-enbridge-to-use-existing-right-of-way-for-line-3-pipeline","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2018\/04\/24\/minnesota-judge-pushes-enbridge-to-use-existing-right-of-way-for-line-3-pipeline\/","title":{"rendered":"Minnesota judge pushes Enbridge to use existing right-of-way for Line 3 pipeline"},"content":{"rendered":"<p>CALGARY \u2014 A judge in Minnesota has ruled that if Enbridge Inc. wants to replace its Line 3 pipeline through the state, it should build the pipeline along the existing right-of-way rather than in its originally planned route.<\/p>\n<p>Calgary-based Enbridge has applied to replace its Line 3 pipeline from Alberta with new pipe along its existing route. But in Minnesota, the last jurisdiction to approve the $7.5-billion replacement project, the company\u2019s planned replacement route meanders away from the existing right-of-way.<\/p>\n<p>Minnesota administrative law judge Ann O\u2019Reilly recommended Monday the replacement project should proceed, but only if the state\u2019s Public Utilities Commission ensures the pipes are replaced along the existing route \u2014 which is not Enbridge\u2019s preference.<\/p>\n<p>O\u2019Reilly found the alternative route \u201cbest satisfies the legal criteria for selection of a pipeline route, as compared to (Enbridge\u2019s) preferred route and the other route alternatives.\u201d<\/p>\n<p>The ruling is strikingly similar to a recent decision in Nebraska affecting competitor TransCanada Corp., in which that state\u2019s public utilities commission approved the company\u2019s Keystone XL pipeline but along an alternative route.<\/p>\n<ul class=\"related_links\">\n<li><a delays, route changes<\/a><\/li>\n<\/ul>\n<p>In the case of Keystone XL, TransCanada and those opposed to the pipeline are now gearing up for an appeal of the approval based on the alternative route selection.<\/p>\n<p>Enbridge said it will review the recommendation.<\/p>\n<p>&#8220;Enbridge is pleased that the Administrative Law Judge has listened to the extensive evidence that there\u2019s need for this safety-driven maintenance project,\u201d company spokesperson Suzanne Wilton said in an email. &#8220;We will be taking time to review in more detail the recommendation that we use the existing right-of-way, and will have additional comments to follow.&#8221;<\/p>\n<p>The alternative route selected by O\u2019Reilly enters and exits Minnesota at the same locations as the original pipeline route, and should not affect the construction work that has already begun in neighbouring jurisdictions.<\/p>\n<p>The company has already begun construction of the pipeline, which will roughly double the line\u2019s ability to ship crude oil to 760,000 barrels per day, both in Canada and Wisconsin.<\/p>\n<p>Line 3 is also one of six Enbridge pipelines that run parallel to each other through the state, which together form the company\u2019s mainline system and is the largest crude oil export system from Canada.<\/p>\n<p>O\u2019Reilly indicated in her decision she might have granted Enbridge\u2019s request for its preferred pipeline route if the company didn\u2019t already operate five other lines along the same right of way in the state, and if it had applied to properly abandon Line 3.<\/p>\n<p>\u201cAbsent the existence of five other lines within the same corridor, and absent the applicant\u2019s request to abandon its old line, the administrative law judge may have made a different recommendation,\u201d she wrote.<\/p>\n<p>\u201cBut under the facts as presented by the parties, this result best balances the public interest in the transportation of energy and the
