{"id":25440,"date":"2026-10-05T16:03:28","date_gmt":"2026-10-05T16:03:28","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=888021"},"modified":"2026-10-05T16:03:28","modified_gmt":"2026-10-05T16:03:28","slug":"some-insurers-incorrect-on-fortified-roofs-endorsements-kentucky-commissioner-says","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2026\/10\/05\/some-insurers-incorrect-on-fortified-roofs-endorsements-kentucky-commissioner-says\/","title":{"rendered":"Some Insurers Incorrect on Fortified Roofs Endorsements, Kentucky Commissioner Says"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/10\/roofing-pic-580x386.jpg\"><\/p>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2026\/10\/05\/888021.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2026\/10\/05\/888021.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p>The Kentucky insurance commissioner is reminding property insurers they have just three weeks to resubmit homeowner policy endorsements that comply with state law on coverage for Fortified roofs.<\/p>\n<p>\u201cUpon review, several FORTIFIED endorsement filings have been found to contain language which violates <a href=\"https:\/\/apps.legislature.ky.gov\/law\/statutes\/statute.aspx?id=57338\">KRS 304.13-346<\/a>,\u201d Commissioner Sharon Clark wrote in a <a href=\"https:\/\/insurance.ky.gov\/ppc\/Documents\/2026-08%20SKH%20Bulletin.pdf\">bulletin<\/a> posted last week.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"carriers\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>Clark explained that House Bill 256, signed into law in 2024, requires HO carriers to offer optional endorsements that will cover the cost, in claims payments, of upgrading homes to the Fortified standard developed by the Insurance Institute for Business and Home Safety. The widely recognized standard has been shown to reduce roof and other damage caused by high winds, with the use of beefed-up secondary water barriers, roof connections and other measures.<\/p>\n<p><a href=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/Fortified-logo.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-888023 size-medium\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/Fortified-logo-300x143.png\" alt width=\"300\" height=\"143\" srcset=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/Fortified-logo-300x143.png 300w, https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/Fortified-logo-580x276.png 580w, https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/Fortified-logo.png 591w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\"><\/a>Insurers were required to start offering the endorsements in March of this year. The law requires coverage for \u201cthe cost to upgrade\u201d single-family homes.<\/p>\n<p>Some insurers, however, have filed endorsements that add exclusion that goes beyond what the law allows. Examples include:<\/p>\n<ul>\n<li>\u201cWe will not pay for: loss if your dwelling or other structures do not meet the IBHS requirements for foundation, roof rafter framing, roof sheathing, or roof decking.\u201d<\/li>\n<li>\u201cWe will not pay for: the increased costs for a more expensive roof material than your existing roof material.\u201d<\/li>\n<\/ul>\n<p>Under the 2024 law, \u201cinsurers shall not exclude mitigation requirements for roof rafter framing, roof sheathing, or roof decking. Additionally, insurers shall not issue FORTIFIED endorsements to homes with foundations ineligible for FORTIFIED designation,\u201d the bulletin explains.<\/p>\n<figure id=\"attachment_888024\" aria-describedby=\"caption-attachment-888024\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/SharonClark.gif\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-888024\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2026\/10\/SharonClark-e1791214998948.gif\" alt width=\"120\" height=\"171\"><\/a><figcaption id=\"caption-attachment-888024\" class=\"wp-caption-text\">Clark<\/figcaption><\/figure>\n<p>Carriers must not exclude the additional costs of more expensive roof materials if those materials are required to reach the Fortified designation. Insurers concerned with the costs associated with FORTIFIED mitigation should instead price the product in accordance with the risk, Clark noted.<\/p>\n<p>Those insurance companies that have submitted incorrect endorsements should withdraw them and submit new filings by Nov. 1.
