{"id":22948,"date":"2024-12-20T17:47:57","date_gmt":"2024-12-20T17:47:57","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=805687"},"modified":"2024-12-20T17:47:57","modified_gmt":"2024-12-20T17:47:57","slug":"chicago-restaurant-owners-to-pay-125k-in-overtime-back-wages","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/12\/20\/chicago-restaurant-owners-to-pay-125k-in-overtime-back-wages\/","title":{"rendered":"Chicago Restaurant Owners to Pay $125K in Overtime Back Wages"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/img\/social\/opengraph\/ij-social-restaurant-1200x630.png\" class=\"ff-og-image-inserted\"><\/div>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/midwest\/2024\/12\/20\/805687.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/midwest\/2024\/12\/20\/805687.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p>The U.S. Department of Labor <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/OPA\/newsreleases\/2024\/12\/241105CHIDSOLNUEZCOJ.pdf\">obtained a consent judgment and order in the U.S. District Court for the Northern District of Illinois on Dec. 2, 2024<\/a>, that requires D\u2019Nuez Corp. and owners Antonio Rendon and Albino Rendon \u2013 operators of three restaurants in Chicago and Berwyn \u2013 to pay 53 employees a total of $125,000 in overtime back wages and liquidated damages \u2013 owed by the employer.<\/p>\n<p>The judgment resolves a Nov. 13, 2024 complaint filed by the department after its <a href=\"https:\/\/www.dol.gov\/agencies\/whd\">Wage and Hour Division<\/a> investigators found the family-operated Chicago companyand its owners violated the Fair Labor Standards Act when they did the following:<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"restaurant\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<ul class=\"usa-list\">\n<li>Failed to pay servers and kitchen staff an overtime premium of time and one-half their hourly rate of pay for hours over 40 in a workweek. The restaurants paid overtime hours in cash at straight time.<\/li>\n<li>Failed to display a Fair Labor Standards Act poster as required.<\/li>\n<\/ul>\n<p>The court\u2019s action follows the division\u2019s review of payroll records at two Mexican-fusion restaurants in Chicago on S. Archer Avenue and W. 18th Street from Feb. 28, 2021, to Sept. 26, 2023, that determined the employers owed $62,500 in back wages to the affected employees. In addition to paying back wages and damages, the employers are forbidden from future FLSA violations.
