{"id":22778,"date":"2024-11-18T06:09:41","date_gmt":"2024-11-18T06:09:41","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=801446"},"modified":"2024-11-18T06:09:41","modified_gmt":"2024-11-18T06:09:41","slug":"amazon-spacex-to-test-us-labor-boards-powers-at-conservative-appeals-court","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/11\/18\/amazon-spacex-to-test-us-labor-boards-powers-at-conservative-appeals-court\/","title":{"rendered":"Amazon, SpaceX to Test US Labor Board\u2019s Powers at Conservative Appeals Court"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2024\/11\/NLRB_-flag-AdobeStock-580x387.jpeg\"><\/p>\n<div><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2024\/11\/NLRB_-flag-AdobeStock-scaled.jpeg\" class=\"ff-og-image-inserted\"><\/div>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2024\/11\/18\/801446.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2024\/11\/18\/801446.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p class=\"tr-story-p1\">A U.S. labor board whose enforcement powers are being challenged in a series of lawsuits is set to defend itself from attacks by Amazon.com and Elon Musk\u2019s SpaceX in a conservative U.S. appeals court, as the agency also braces for a potential overhaul under President-elect Donald Trump.<\/p>\n<p>Amazon, SpaceX and many other companies are going on the offensive by suing the National Labor Relations Board in order to block it from pursuing cases accusing them of illegal labor practices, part of a broader onslaught by businesses and conservative groups on the \u201cadministrative state.\u201d<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"aerospace\" data-revive-companies=\"amazon,spacex\" data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The Amazon and SpaceX cases being heard by the New Orleans-based 5th U.S. Circuit Court of Appeals on Monday are among the first of more than two dozen similar lawsuits \u2013 which claim the NLRB\u2019s structure is unconstitutional \u2013 that have reached influential U.S. appeals courts.<\/p>\n<p>Court rulings invalidating the agency\u2019s in-house proceedings could bring the board\u2019s work to a standstill. And they could potentially tee up review by the U.S. Supreme Court, whose conservative majority has in recent years reined in the powers of federal agencies.<\/p>\n<p>The NLRB is the agency that enforces private-sector employees\u2019 rights to advocate for better working conditions, organize, and join unions. The board\u2019s general counsel issues complaints accusing employers or unions of illegal practices, which are heard by administrative judges whose decisions can be reviewed by the five-member board.<\/p>\n<p>Democratic President Joe Biden has proclaimed himself the most pro-union president in U.S. history and his appointees to the board have kept pace, issuing a series of rulings that have boosted union organizing and riled trade groups.<\/p>\n<p>The challenges to the board come as unions are filing petitions to hold elections and winning them at rates not seen in decades. Companies including Amazon, Starbucks and EV maker Tesla, where Musk is chief executive, have frequently been in the agency\u2019s crosshairs as they have faced the first union campaigns in their history. Some of them are now pushing back by claiming the NLRB\u2019s enforcement proceedings are unlawful.<\/p>\n<p>Trump\u2019s election to a second White House term could separately hobble the NLRB as the Republican and his supporters \u2013 including Musk, who has emerged as a top adviser to Trump \u2013 have vowed to curb the powers of administrative agencies.<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-topics=\"aerospace\" data-revive-companies=\"amazon,spacex\" data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>Trump\u2019s appointees to the labor board may also be less inclined to vigorously defend it from legal attacks, including these lawsuits, and could be more likely to acquiesce to appeals courts that invalidate parts of its structure, experts said.<\/p>\n<p>Trump\u2019s transition team did not immediately respond to a request for comment.<\/p>\n<p>\u2018PLAY HARD BALL\u2019<\/p>\n<p>Amazon and SpaceX claim that the NLRB\u2019s five members appointed by the president are <a class=\"bold1 mr5 tr-link tr-pnac tr-link-story-internal\" href=\"https:\/\/www.reutersconnect.com\/all?search=all%3AL1N3LD0NJ&amp;linkedFromStory=true\" target=\"_blank\" rel=\"noopener\">improperly shielded<\/a> from being removed at will by the White House, and that the agency\u2019s administrative process violates the constitutional separation of powers and the companies\u2019 right to a jury trial. SpaceX also says that the president should be able to <a class=\"bold1 mr5 tr-link tr-pnac tr-link-story-internal\" href=\"https:\/\/www.reutersconnect.com\/all?search=all%3AL1N3DU22R&amp;linkedFromStory=true\" target=\"_blank\" rel=\"noopener\">fire administrative judges<\/a> who hear board cases at will.<\/p>\n<p>Amazon is seeking to block the NLRB from ruling on whether it must bargain with <a class=\"bold1 mr5 tr-link tr-pnac tr-link-story-internal\" href=\"https:\/\/www.reutersconnect.com\/all?search=all%3AL4N38Z0GD&amp;linkedFromStory=true\" target=\"_blank\" rel=\"noopener\">the first union in its history<\/a> at a New York City warehouse. SpaceX is fighting an NLRB case accusing it of <a class=\"bold1 mr5 tr-link tr-pnac tr-link-story-internal\" href=\"https:\/\/www.reutersconnect.com\/all?search=all%3AL2N3FF2TT&amp;linkedFromStory=true\" target=\"_blank\" rel=\"noopener\">firing engineers<\/a> critical of Musk. Each company has filed <a class=\"bold1 mr5 tr-link tr-pnac tr-link-story-internal\" href=\"https:\/\/www.reutersconnect.com\/all?search=all%3AL1N3J20Y1&amp;linkedFromStory=true\" target=\"_blank\" rel=\"noopener\">a second lawsuit<\/a> against the NLRB stemming from separate board cases, which are also likely to end up at the 5th Circuit.<\/p>\n<p>Amazon and SpaceX, which have denied wrongdoing in the underlying board cases, did not respond to requests for comment.<\/p>\n<p>NLRB General Counsel Jennifer Abruzzo, a Biden appointee, said in a statement that the U.S. Supreme Court had upheld the agency\u2019s structure nearly 90 years ago and that despite the legal challenges, the board would continue to carry out its mission.<\/p>\n<p>\u201cWhile the current challenges require the NLRB to expend scarce resources defending against them, we\u2019ve seen that the results of these kinds of challenges is ultimately a delay in justice, but that ultimately justice does prevail,\u201d Abruzzo said.<\/p>\n<p>A growing number of similar cases challenging the NLRB\u2019s structure has been filed in courts nationwide. But an outsized proportion of them, including the Amazon and SpaceX cases, had their start in federal courts in Texas. Those courts, overseen by the 5th Circuit, have become a favored destination for companies and conservative groups challenging the powers of U.S. agencies.<\/p>\n<p>Critics, including the NLRB, call the practice \u201cjudge shopping\u201d and have sought to curb it, including by asking judges to transfer cases out of Texas. Many of those same critics have accused companies suing the NLRB of seeking to distract from their violations of workers\u2019 rights to advocate for better working conditions.<\/p>\n<p>The 5th Circuit is widely considered the most conservative federal appeals court, with 12 of its 17 active judges appointed by Republican presidents, and has issued several rulings in recent years curbing federal agencies\u2019 powers.<\/p>\n<p>\u201cIt\u2019s been this signal for employers that if you want to play hard ball, you go to the 5th Circuit,\u201d said Andrew Strom, a lawyer with a New York City-based affiliate of the Service Employees International Union.<\/p>\n<p>Three Texas judges who recently blocked NLRB cases all cited a 5th Circuit decision in 2022 against the U.S. Securities and Exchange Commission, which has a similar structure to the labor board.
