{"id":22541,"date":"2024-09-30T16:53:44","date_gmt":"2024-09-30T16:53:44","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=794962"},"modified":"2024-09-30T16:53:44","modified_gmt":"2024-09-30T16:53:44","slug":"new-orleans-doj-move-to-end-police-departments-consent-decree","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/09\/30\/new-orleans-doj-move-to-end-police-departments-consent-decree\/","title":{"rendered":"New Orleans, DOJ Move to End Police Department\u2019s Consent Decree"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/img\/social\/opengraph\/ij-social-default-1200x630.png\" class=\"ff-og-image-inserted\"><\/div>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/southcentral\/2024\/09\/30\/794962.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/southcentral\/2024\/09\/30\/794962.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p>NEW ORLEANS (AP) \u2014 New Orleans and the U.S. Department of Justice filed a motion Friday in federal court to take steps to end long-standing <a href=\"https:\/\/apnews.com\/article\/new-orleans-police-reforms-cantrell-katrina-7b24d87b9b96aa99c45a05f5faad01b3\">federal oversight<\/a> of the city\u2019s police department.<\/p>\n<p>The city and the federal government had agreed to a reform pact for the New Orleans Police Department known as a consent decree in 2013, two years after a Department of Justice investigation <a href=\"https:\/\/apnews.com\/article\/police-new-orleans-mitch-landrieu-92e205f5f2264ffbb71f1bc029c3b5bc\">found evidence<\/a> of racial bias and misconduct from the city\u2019s police.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"law-enforcement\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The Justice Department had <a href=\"https:\/\/apnews.com\/article\/police-new-orleans-mitch-landrieu-92e205f5f2264ffbb71f1bc029c3b5bc\">found in 2011<\/a> that New Orleans police used deadly force without justification, repeatedly made unconstitutional arrests and engaged in racial profiling. Officer-involved shootings and in-custody deaths were \u201cinvestigated inadequately or not at all\u201d the <a href=\"https:\/\/apnews.com\/article\/police-new-orleans-mitch-landrieu-92e205f5f2264ffbb71f1bc029c3b5bc\">Justice Department said<\/a>.<\/p>\n<p>If U.S. District Judge Susie Morgan of the Eastern District of Louisiana approves the motion, the city and its police department will have two more years under federal oversight to show they are complying with reform measures enacted during the consent decree before it is lifted.<\/p>\n<p>\u201cToday\u2019s filing recognizes the significant progress the City of New Orleans and the New Orleans Police Department have made to ensure constitutional and fair policing,\u201d said Assistant Attorney General Kristen Clarke of the Justice Department\u2019s Civil Rights Division in a statement.<\/p>\n<p>Morgan said in a statement that she plans to hold a public hearing within the next 45 days to allow members of the community to weigh in on whether they think the city and its police department should be allowed to wind down federal oversight.<\/p>\n<p>Colin Reingold, the legal director for the Promise of Justice Initiative, welcomed citizen input.<\/p>\n<p>\u201cThe harms NOPD has committed are not harms of the past, and the need for police accountability in Louisiana is still as great as it has ever been,\u201d he said in a statement. \u201cNOPD is a long way from restoring trust with the communities we represent. Federal oversight of NOPD practices, though not a panacea, was and remains an important check on abuses of power, and NOPD straining to get out from under that oversight suggests that the lessons of the consent decree have not sunk in or led to long lasting reforms. The discussion about moving on from the consent decree should be had with the community before it is brought to the court.\u201d<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-topics=\"law-enforcement\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The city\u2019s Independent Police Monitor Stella Cziment said in a statement that the voices of city residents must be \u201cheard, considered and weighed\u201d in determining whether to allow the consent decree process to enter its final stages. But she noted the consent decree was always intended to be phased out over time.<\/p>\n<p>\u201cThe reforms put into place, the officers that embrace those reforms, and the community that championed the reforms are not going anywhere,\u201d she said. \u201cThe work continues.\u201d<\/p>\n<p>The Office of the Independent Police Monitor is an independent civilian police oversight agency created by voters in a 2008 charter referendum. It is tasked with holding the police department accountable and ensuring it is following its own rules, policies, as well as city, state and federal laws.<\/p>\n<p>Relations between Morgan and New Orleans Mayor LaToya Cantrell <a href=\"https:\/\/apnews.com\/article\/police-new-orleans-mitch-landrieu-92e205f5f2264ffbb71f1bc029c3b5bc\">have been strained<\/a>, with the mayor saying the consent decree has been a drain on the city\u2019s resources. Complying with federal monitoring has cost the city millions.<\/p>\n<p>The mayor\u2019s office said it would release a statement later Friday regarding the filing.<\/p>\n<p>Morgan said she \u201capplauds the progress\u201d the New Orleans Police Department had made so far. She added that the court would take \u201cswift and decisive action\u201d if the city and police department failed to follow the ongoing reform efforts.<\/p>\n<div class=\"copyright-notice lite\">Copyright 2024 Associated Press.
