BSW said its claim was predicated on physical loss and\/or physical damage to property caused by, among other things, the presence of COVID-19\u2033 at its facilities.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"business-interruption,covid-19,lawsuits,medical-professional-liability\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The policy BSW purchased from Factory Mutual covered two general types of claims \u2013 property damage and time element claims. The policy excludes coverage for contamination, and any cost due to contamination including the inability to use or occupy property or any cost of making property safe or suitable for use or occupancy.<\/p>\n<p>The policy contains additional coverages, including the Communicable Disease Response Extension and the Interruption by Communicable Disease Extension. Under the extensions, the policy covers up to $5 million for cleanup, removal and disposal of the presence of communicable diseases, and costs for public relations services or reputation management resulting from the presence of communicable diseases. Both parties agree that the $5 million limit has been paid out in full for the implicated policy year.<\/p>\n<p>In March 2023 a district court granted Factory Mutual\u2019s motion to dismiss BSW\u2019s lawsuit seeking business interruption losses. The court found that given existing circuit precedent, BSW had not plausibly alleged \u201cphysical loss or damage\u201d under the Policy, and the Contamination Exclusion and Loss of Use Exclusion barred BSW\u2019s recovery under the Policy. BSW appealed the district court\u2019s order.<\/p>\n<p>The 5th Circuit panel affirmed the district court\u2019s ruling in a 2-1 decision, finding that in context of previous COVID-19 commercial-insurance coverage disputes, COVID-19 does not physically damage property within the plain meaning of \u2018physical.\u2019<\/p>\n<p>BSW argues that its policy language is unique because it covers \u2018physical loss or damage\u2019 caused by communicable disease,\u201d making the coverage broader than a typical policy. BSW further contends that its complaint was wrongly dismissed because no other case previously \u201cincluded specific factual allegations of demonstratable, measurable, and tangible alteration of property\u201d caused by COVID-19.<\/p>\n<p>The panel acknowledged the \u201cgreat scientific detail\u201d BSW went through in explaining how COVID-19 physically altered the surfaces of its property but did not budge.<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-topics=\"business-interruption,covid-19,lawsuits,medical-professional-liability\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<div class=\"page\" title=\"Page 8\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>\u201cThe alleged uniqueness of the Policy\u2019s language does not change that we have determined, as a matter of law, COVID-19 does not cause physical loss or damage to property,\u201d Judge Irma Carrillo Ramirez wrote in the majority opinion.<\/p>\n<div class=\"page\" title=\"Page 10\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Judge Jennifer Walker Elrod dissented, however, arguing BSW adequately showed that COVID-19 created a tangible alteration to or depravation of its property.<\/p>\n<p>BSW explained how the spike proteins on the outside of the COVID-19 virus attach to metallic surfaces and bond with oxygen-containing surfaces such as wood, cotton, or glass to \u201cphysically alter the roughness of those surfaces and to make the surfaces more likely to repel water,\u201d Elrod wrote in her dissent.<\/p>\n<p>BSW cited research from peer-reviewed scientific journals in support of its argument.<\/p>\n<p>Elrod wrote that the case serves as an example for why the court\u2019s precedent that COVID-19 does not physically damage property within the plain meaning of \u2018physical\u2019 should not should not be understood as a legal rule, but rather as an \u201cexplanation of why the mine-run COVID-19 insurance policy case fails.\u201d<\/p>\n<p>This case is distinct, Elrod wrote, because BSW \u201cpleaded tangible alterations to the property, instead of merely alleging \u201cphysical harm\u201d in a conclusory manner.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"tagtag\"> <span class=\"tagtag\">Topics<\/span> <a href=\"https:\/\/www.insurancejournal.com\/lawsuits\/\" class=\"btn btn-sm btn-primary tagtag\">Lawsuits<\/a> <a href=\"https:\/\/www.insurancejournal.com\/location\/texas\/\" class=\"btn btn-sm btn-primary tagtag\">Texas<\/a> <a href=\"https:\/\/www.insurancejournal.com\/covid-19\/\" class=\"btn btn-sm btn-primary tagtag\">COVID-19<\/a> <\/p>\n<\/p><\/div>\n<div class=\"article-poll\" data-post=\"781759\">\n<div class=\"article-poll-vote\">\n<p>Was this article valuable?<\/p>\n<\/p><\/div>\n<div class=\"article-poll-feedback voted-no\">\n<form class=\"feedback-form\">\n<p>Thank you!
