{"id":21701,"date":"2024-04-16T05:01:57","date_gmt":"2024-04-16T05:01:57","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=770017"},"modified":"2024-04-16T05:01:57","modified_gmt":"2024-04-16T05:01:57","slug":"supplemental-claims-dont-need-to-include-damage-estimates-fed-appeals-court-says","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/04\/16\/supplemental-claims-dont-need-to-include-damage-estimates-fed-appeals-court-says\/","title":{"rendered":"Supplemental Claims Don\u2019t Need to Include Damage Estimates, Fed Appeals Court Says"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2024\/04\/Bay-Harbor-Islands-580x326.jpeg\"><\/p>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2024\/04\/16\/770017.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2024\/04\/16\/770017.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p>A federal appeals court has, at least for now, put an end to lingering questions about some property insurance claims litigation: The insured does not need to submit a competing damage estimate when filing a supplemental claim if the policy does not require it.<\/p>\n<p>But one of the underlying cases that the decision rests on could soon be taken up by the Florida Supreme Court, and that court\u2019s opinion could ultimately impact Monday\u2019s 11<sup>th<\/sup> U.S. Circuit Court of Appeals ruling.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"claims\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The 11<sup>th<\/sup> Circuit said in Great Lakes Insurance vs. Concourse Plaza A Condominium Association that the association had waited almost three years to provide a damage estimate and supplemental claim after Hurricane Irma. But that did not violate Florida\u2019s supplemental claims statute, the court said.<\/p>\n<p>\u201c\u2026Great Lakes concedes that the insurance policy by itself \u2018does not impose a requirement to provide an estimate of damages,&#8217;\u201d the <a href=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2024\/04\/11th-circ-on-damage-estimates.pdf\">11<sup>th<\/sup> Circuit judges wrote<\/a>. Concourse Plaza\u2019s September 2020 letter \u201ctherefore qualifies as a notice of a supplemental claim under Fla. Stat. \u00a7 627.70132. Because it was sent within three years of the date Hurricane Irma made landfall, the provisions of Fla. Stat. \u00a7 627.70132 were satisfied.\u201d<\/p>\n<p>The ruling reversed a lower federal court\u2019s decision and remanded the case for further proceedings.<\/p>\n<p>The case began in 2017. After Irma blew through, the association in Bay Harbor Islands, near Miami Beach, filed an initial claim with Great Lakes, noting wind and water damage. The insurer sent an adjuster and concluded the loss was well below the $195,210 deductible, the appellate judges explained. More than two years after Great Lakes denied the claim, Concourse Plaza sent a letter disputing the insurer\u2019s damage estimate and notifying Great Lakes that the condos intended to pursue additional insurance benefits under its policy.<\/p>\n<p>It wasn\u2019t until April 2021 that the condo association submitted its own estimate \u2013 $6.4 million, which it later reduced to $3.3 million. The association also demanded an appraisal to decide on the dollar amount of the loss. Great Lakes asked the federal district court in Miami to declare that the Concourse letter did not include an estimate and, thus, was not a valid notice filed within the three-year statutory window in effect at the time. (Florida lawmakers in 2022 reduced that supplemental claims window to 18 months.)<\/p>\n<p>The trial court sided with Great Lakes, the insurance company, holding that the statute requires a damage estimate. But the 11<sup>th<\/sup> Circuit felt differently. The appellate judges said that a federal court in this type of case is bound by a state\u2019s previous appeals court decisions. Florida\u2019s 3<sup>rd<\/sup> and 4<sup>th<\/sup> District Courts of Appeals have rendered conflicting opinions in recent years, and the Florida Supreme Court has yet to consider the issue.<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-topics=\"claims\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>One of the state appeals court decisions was by the 3<sup>rd<\/sup> DCA, in <a href=\"https:\/\/acis-api.flcourts.gov\/courts\/8a73be7f-864b-42a9-b8ad-1ec0a3e890b4\/cms\/case\/d3eb3206-70fa-4605-9adc-e0bf657323a9\/docketentrydocuments\/43dcaea8-9e28-4dcf-aa3c-929a11bfeed7\">Patios West One Condominium Association vs. American Coastal Insurance<\/a>, handed down in January. The state court decided that state law does not mandate that a supplemental claim include an estimate of additional damages and the statute deals only with notices of claims.<\/p>\n<p>Because the 3<sup>rd<\/sup> DCA covers Miami, where the federal Concourse Plaza case originated, the 11<sup>th<\/sup> Circuit judges said they had to go with that court\u2019s opinion, regardless of whether they agreed with the reasoning behind it.<\/p>\n<p>The decision gives insureds some flexibility on filing claims but it also complicates claims handling for insurers, attorneys in the state said. For months, an insurer won\u2019t have an idea of the amount of a competing damage amount, making negotiations difficult.<\/p>\n<p>All of that could change, perhaps later this year or early next year. American Coastal Insurance has asked the Florida Supreme Court to take up the Patios case decision.
