id=\"first-para\">The Financial Services Institute and its coalition partners filed an amended complaint Tuesday against the Labor Department\u2019s new independent contrator rule, which asks the court to&nbsp;declare the 2024 rule invalid, prohibit its implementation and allows the 2021 independent contractor rule to remain in effect.<\/p>\n<p>FSI filed <a href=\"https:\/\/media.financialservices.org\/wp-content\/uploads\/2024\/03\/FSI-and-Coalition-Amended-Complaint.pdf\" target=\"_blank\" rel=\"noopener\">the amended complaint<\/a> in the U.S. District Court for the Eastern District of Texas along with the&nbsp;Associated Builders and Contractors,&nbsp;the American Trucking Association, the Coalition for Workforce Innovation, the National Retail Federation, the National Federation of Independent Business and the U.S. Chamber of Commerce.<\/p>\n<p>The complaint states that the 2024 rule, which <a href=\"https:\/\/www.thinkadvisor.com\/2024\/01\/09\/dol-releases-final-independent-contractor-rule\/\" target=\"_blank\" rel=\"noopener\">Labor finalized on Jan. 9<\/a>, is arbitrary and capricious under the Administrative Procedure Act&nbsp;and also violates the Regulatory Flexibility Act.<\/p>\n<p>An FSI spokesperson told ThinkAdvisor Tuesday in an email that the amended complaint&nbsp;replaces the <a href=\"https:\/\/www.thinkadvisor.com\/2024\/01\/16\/fsi-resumes-legal-fight-over-dol-independent-contractor-rule\/\" target=\"_blank\" rel=\"noopener\">earlier complaint filed on Jan. 16<\/a>, which challenged DOL\u2019s withdrawal of the 2021 independent contractor rule.<\/p>\n<p>The new amended complaint, the spokesperson said, reflects \u201cour concerns with the final DOL rule\u201d and adds new plaintiffs.<\/p>\n<p>The department, according to the amended suit,&nbsp;\u201dhas issued a new rule that largely repeats the Department\u2019s previous errors and fails to remedy the confusion addressed by the 2021 Independent Contractor Rule.\u201d<\/p>\n<p>The 2024 rule \u201crepeals the 2021 Independent Contractor Rule currently in effect and substitutes an amorphous, vague, and unworkable standard for determining employee or independent contractor status\u201d under the Fair Labor Standards Act, or FLSA, the suit
