{"id":21290,"date":"2024-01-19T17:34:09","date_gmt":"2024-01-19T17:34:09","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=756409"},"modified":"2024-01-19T17:34:09","modified_gmt":"2024-01-19T17:34:09","slug":"medical-experts-may-be-needed-even-in-negligence-claims-kentucky-supreme-court","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/01\/19\/medical-experts-may-be-needed-even-in-negligence-claims-kentucky-supreme-court\/","title":{"rendered":"Medical Experts May be Needed, Even in Negligence Claims \u2013 Kentucky Supreme Court"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2015\/11\/Wheelchair-580x522.jpg\"><\/p>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2024\/01\/19\/756409.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/southeast\/2024\/01\/19\/756409.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p>When a baseball umpire, well-traveled in college conferences, went to a hospital for X-rays on his surgically repaired ankle in 2015, a hospital attendant pushing the ump\u2019s wheelchair accidentally bumped his foot against a desk.<\/p>\n<p>The question that has percolated through Kentucky courts since then is: Does the case require a medical expert to testify on whether the bump caused the repaired ankle bone to be dislocated, resulting in a negligence claim against Saint Elizabeth Medical Center in Florence, Kentucky?<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-topics=\"claims,medical-professional-liability\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>A circuit court in Boone County said that expert testimony was needed, and dismissed umpire Ron Arnsperger\u2019s lawsuit. Then, the state Court of Appeals disagreed, noting that it was a simple matter of negligence by the hospital, no medical expertise was required and the suit could move forward.<\/p>\n<p>On Thursday, the Kentucky Supreme Court reversed the appeals court. The high court found that an expert was indeed necessary, given the long history of Arnsperger\u2019s problems with his ankle, problems that included a surgery that went awry when a drill bit broke and left metal shards inside the incision.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-749735\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-300x200.jpg\" alt width=\"246\" height=\"164\" srcset=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-300x200.jpg 300w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-580x387.jpg 580w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-768x512.jpg 768w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-1536x1024.jpg 1536w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/11\/FTX-MLB-umpire-Bloomberg-2048x1366.jpg 2048w\" sizes=\"(max-width: 246px) 100vw, 246px\"><\/p>\n<p>The Supreme Court decision is seen as a win for the hospital and its malpractice insurer.<\/p>\n<p>\u201cArnsperger has failed to raise a genuine issue of material fact, and this failure means that under no circumstances could his claim succeed,\u201d the Supreme Court justices wrote. \u201cThe Court of Appeals is reversed, and we reinstate the summary judgment of the trial court.\u201d<\/p>\n<p>The ruling could give succor to Kentucky hospitals, medical providers and insurers, going forward. The justices said in the opinion that they felt compelled to correct a drift in court decisions in recent years, one that had seen an expanded use of the legal doctrine known as <em>res ipsa loquitur<\/em>, or \u201cthe thing speaks for itself.\u201d<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-topics=\"claims,medical-professional-liability\" data-revive-companies data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>Juries may not need a medical expert to determine causation when cause and effect is obvious, such as when a surgical instrument is left inside a body, the court said.
