{"id":21210,"date":"2024-01-04T14:14:35","date_gmt":"2024-01-04T14:14:35","guid":{"rendered":"https:\/\/www.insurancejournal.com\/?p=754349"},"modified":"2024-01-04T14:14:35","modified_gmt":"2024-01-04T14:14:35","slug":"ftc-reaches-settlement-with-xcast-labs-over-illegal-robocalls","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2024\/01\/04\/ftc-reaches-settlement-with-xcast-labs-over-illegal-robocalls\/","title":{"rendered":"FTC Reaches Settlement With XCast Labs Over Illegal Robocalls"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/05\/robocalls-cellphone-AP-580x414.jpg\"><\/p>\n<div><img decoding=\"async\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/05\/robocalls-cellphone-AP.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<ul class=\"nav nav-tabs tabs tabs-entry\">\n<li class=\"active\"><a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2024\/01\/04\/754349.htm\">Article<\/a><\/li>\n<li><a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2024\/01\/04\/754349.htm?comments\" rel=\"nofollow\">0 Comments<\/a><\/li>\n<\/ul>\n<div class=\"article-content clearfix\">\n<p class=\"tr-story-p1\">U.S. regulators and XCast Labs have <span class=\"tr-strong\">agreed on a proposed settlement of <\/span>charges that the company facilitated billions of illegal robocalls, the Federal Trade Commission (<span class=\"tr-strong\">FTC) <\/span>said on Tuesday.<\/p>\n<p>The FTC also ordered the Voice over Internet Protocol (VoIP) provider to pay a $10 million civil penalty but suspended the fine \u201cbased on its inability to pay,\u201d it said in a statement.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>The penalty will be due immediately if XCast \u201cmisrepresented its financial condition<span class=\"tr-strong\">,\u201d and XCast must cut ties with firms that do not follow telemarketing rules, it added.<\/span><\/p>\n<p>Regulators sued Los Angeles-based XCast over charges it helped other companies contact people on the National Do Not Call Registry and generally deceive them into making purchases or contributions after previously warning the company multiple times.<\/p>\n<p><strong>Related:<\/strong> <a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2023\/05\/25\/722253.htm\" target=\"_blank\" rel=\"noopener\">Do Not Call: States Sue Telecom Company Over Billions of Robocalls<\/a><\/p>\n<p>\u201cCompanies that turn a blind eye to illegal robocalling should expect to hear from the FTC,\u201d Samuel Levine, director of the FTC\u2019s Bureau of Consumer Protection, said in the statement.<\/p>\n<p><span class=\"tr-strong\">The company said the FTC press release violated the spirit of the settlement \u201cwhich was that XCAST LABS did not admit to any violations, but agreed to not do what it was already not doing to avoid a costly and protracted defense.\u201d<\/span><\/p>\n<p>The U.S. Department of Justice\u2019s Civil Division Principal Deputy Assistant Attorney General Brian Boynton said Tuesday\u2019s order highlighted the department\u2019s \u201cefforts to protect American consumers from illegal robocalls and to stop telecommunications providers from enabling those calls.\u201d<\/p>\n<div class=\"bzn bzn-sized bzn-intext-2\">\n<ins data-revive-zoneid=\"162\" data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<p>As part of the proposed settlement filed with the U.S. District Court for Central District of California, XCast must start using a screening process and halt its ties with firms that do not comply with U.S. telemarketing laws, the FTC said.<\/p>\n<p>Under a separate settlement with the FTC, California-based Response Tree LLC and its president, Derek Thomas Doherty, were banned by the agency from making or assisting anyone else in making robocalls or calls to phone numbers on the Do Not Call Registry, the agency said.<\/p>\n<p>The FTC had accused Response Tree of operating more than 50 websites designed to trick consumers into providing their personal information for supposed mortgage refinancing loans and other services.<\/p>\n<p>Reuters was unable to contact Response Tree for comment.<\/p>\n<\/p><\/div>\n<div class=\"article-poll\" data-post=\"754349\">\n<div class=\"article-poll-vote\">\n<p>Was this article valuable?<\/p>\n<\/p><\/div>\n<div class=\"article-poll-feedback voted-no\">\n<form class=\"feedback-form\">\n<p>Thank you!
