But a federal appeals court found that jury instructions were improper and ordered a new trial, set for Nov. 6, a month from now.<\/p>\n<div class=\"bzn bzn-sized bzn-intext\">\n<ins data-revive-zoneid=\"79\" data-revive-block=\"1\" data-revive-id=\"36eb7c2bd3daa932a43cc2a8ffbed3a9\"><\/ins> <\/div>\n<figure id=\"attachment_725223\" aria-describedby=\"caption-attachment-725223\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-725223\" src=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/06\/Greg_Lindberg_633_Days-scaled-e1686752555135-207x300.jpg\" alt width=\"131\" height=\"190\" srcset=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/06\/Greg_Lindberg_633_Days-scaled-e1686752555135-207x300.jpg 207w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/06\/Greg_Lindberg_633_Days-scaled-e1686752555135-401x580.jpg 401w, https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/06\/Greg_Lindberg_633_Days-scaled-e1686752555135.jpg 716w\" sizes=\"(max-width: 131px) 100vw, 131px\"><figcaption id=\"caption-attachment-725223\" class=\"wp-caption-text\">Lindberg<\/figcaption><\/figure>\n<p>Prosecutors have said that co-defendant John Gray, of Chapel Hill, North Carolina, a business partner of Lindberg\u2019s, worked with Lindberg in attempting to funnel large campaign contributions to Commissioner Mike Causey, so that his office might provide more relaxed regulation of Lindberg\u2019s insurance companies. The indictment, once sealed, <a href=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/10\/lindberg-indictment.pdf\">can be seen here<\/a>.<\/p>\n<p>This week, Gray asked a judge to delay the retrial until April 2024.<\/p>\n<p>Federal prosecutors had challenged the fact that Gray was represented by the Parker Poe law firm, which had earlier represented another co-defendant who was acquitted. Parker Poe attorneys in August withdrew and another firm just last month took over Gray\u2019s defense. Now, the lawyers say they need more time to prepare.<\/p>\n<p>\u201cDiscovery for the initial trial was voluminous, including more than 80 hours of recorded conversations between the defendants and witnesses cooperating with the government,\u201d Gray\u2019s <a href=\"https:\/\/www.insurancejournal.com\/app\/uploads\/2023\/10\/Gray-motion-to-delay.pdf\">motion to continue<\/a> reads. \u201cIn December 2022, the government provided six million pages of supplemental discovery in a related case involving Mr. Lindberg.\u201d<\/p>\n<p>The motion does not directly address Lindberg\u2019s case, and Lindberg may not need to be retried at the same time as Gray, the Carolina Journal <a href=\"https:\/\/www.carolinajournal.com\/court-filing-suggests-possible-delay-of-lindberg-bribery-retrial-to-2024\/\">news site reported<\/a>. But the judge in the case already has delayed the second trial for both men because of Gray\u2019s legal representation.
