{"id":19241,"date":"2020-08-14T15:15:00","date_gmt":"2020-08-14T19:15:00","guid":{"rendered":"https:\/\/www.benefitscanada.com\/news\/ontario-court-rules-again-for-employees-in-cibc-overtime-class-action-148861"},"modified":"2020-08-14T15:15:00","modified_gmt":"2020-08-14T19:15:00","slug":"ontario-court-rules-again-for-employees-in-cibc-overtime-class-action","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2020\/08\/14\/ontario-court-rules-again-for-employees-in-cibc-overtime-class-action\/","title":{"rendered":"Ontario court rules again for employees in CIBC overtime class action"},"content":{"rendered":"<div class=\"alignleft clearfix\">\n<div class=\"wp-caption feature-image alignleft\"> <img decoding=\"async\" loading=\"lazy\" width=\"316\" height=\"190\" src=\"https:\/\/www.benefitscanada.com\/wp-content\/uploads\/2016\/05\/CIBC-Shutterstock1.jpg\" class=\"attachment-feature size-feature wp-post-image\" alt title=\"Ontario court rules again for employees in CIBC overtime class action\"> <\/div>\n<\/p><\/div>\n<p class=\"byline\"> <span>Staff <\/span>&nbsp;|&nbsp;August 14, 2020 <\/p>\n<p>The Ontario Superior Court of Justice&nbsp;has issued additional reasons for&nbsp;judgment in a long-running unpaid overtime class action lawsuit against Canadian Imperial Bank of Commerce.<\/p>\n<p>The court has followed up on its&nbsp;summary judgment decision from&nbsp;<span class=\"xn-chron\">March 30, 2020<\/span>, ruling&nbsp;the bank\u2019s current overtime policy is illegal and unenforceable and that frontline employees who are members of the class are entitled to monetary damages for CIBC\u2019s failure to pay overtime.<\/p>\n<p>In the most recent decision, released on&nbsp;<span class=\"xn-chron\">Aug. 10<\/span>,&nbsp;<span class=\"xn-person\">Justice Edward Belobaba<\/span>&nbsp;said CIBC\u2019s overtime policy is illegal and that it breached employment contracts and the federal labour code. He concluded class members are entitled to damages arising out the bank\u2019s breaches of the class members\u2019 employment contracts.<\/p>\n<p><strong>Read:&nbsp;<a href=\"https:\/\/www.benefitscanada.com\/news\/former-starbucks-canada-employee-sues-for-unpaid-ot-on-behalf-of-store-managers-148819\">Former Starbucks Canada employee suing for unpaid OT on behalf of store managers<\/a><\/strong><\/p>\n<p>In rejecting the arguments of CIBC\u2019s lawyers, Justice&nbsp;<span class=\"xn-person\">Belobaba<\/span>&nbsp;noted CIBC, \u201cin violation of federal law, failed to make and keep records of the \u2018hours worked&#8217;\u201d&nbsp;and that having \u201cfailed to keep the required records, the defendant bank now says that every aggrieved class member should be required to prove their case \u2014 and if it takes some 30,000 or more individual trials, so be it.\u201d<\/p>\n<p>The court will now give CIBC the time to extract time-stamped computer data so the plaintiff\u2019s expert can complete his aggregate damages report, which will summarize the compensation to be awarded.&nbsp;It will then decide whether to make an aggregate damages award.<\/p>\n<p>\u201cThis is another important step towards finally getting the class members fair and meaningful compensation for their years of unpaid work performed for the benefit of the bank,\u201d said lead class counsels&nbsp;<span class=\"xn-person\">David O\u2019Connor<\/span>,&nbsp;<span class=\"xn-person\">Louis Sokolov<\/span>&nbsp;and&nbsp;<span class=\"xn-person\">Steven Barrett in a press release.<\/span><\/p>\n<p>In a statement, the CIBC said it believes it has effective overtime policies and practices in place, including a clear overtime policy that\u2019s easily accessible. \u201cWe\u2019re reviewing this latest decision and assessing next steps, including whether to add to our existing appeal.\u201d<\/p>\n<p><strong>Read:&nbsp;<a href=\"https:\/\/www.benefitscanada.com\/human-resources\/other\/update-on-bill-47-and-changes-to-employment-standards-act-2000-125290\">A summary of Ontario\u2019s changing employment and labour legislation<\/a><\/strong><\/p>\n<p> <a href=\"https:\/\/www.benefitscanada.com\/news\/ontario-court-rules-again-for-employees-in-cibc-overtime-class-action-148861\">Read the full article at BenefitsCanada.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Staff &nbsp;|&nbsp;August 14, 2020 The Ontario Superior Court of Justice&nbsp;has issued additional reasons for&nbsp;judgment in a long-running unpaid overtime class action lawsuit against Canadian Imperial Bank of Commerce.
