{"id":18342,"date":"2020-05-11T09:00:15","date_gmt":"2020-05-11T13:00:15","guid":{"rendered":"https:\/\/www.benefitscanada.com\/news\/miners-union-seeking-court-guarantee-for-dominion-diamond-to-meet-pension-obligations-145933"},"modified":"2020-05-11T09:00:15","modified_gmt":"2020-05-11T13:00:15","slug":"miners-union-seeking-court-guarantee-for-dominion-diamond-to-meet-pension-obligations","status":"publish","type":"post","link":"https:\/\/blog.lifeinsurance-orleans.ca\/index.php\/2020\/05\/11\/miners-union-seeking-court-guarantee-for-dominion-diamond-to-meet-pension-obligations\/","title":{"rendered":"Miners\u2019 union seeking court guarantee for Dominion Diamond to meet pension obligations"},"content":{"rendered":"<div class=\"alignleft clearfix\">\n<div class=\"wp-caption feature-image alignleft\"> <img decoding=\"async\" loading=\"lazy\" width=\"350\" height=\"263\" src=\"https:\/\/www.benefitscanada.com\/wp-content\/uploads\/2020\/03\/39542673_l-350x263.jpg\" class=\"attachment-feature size-feature wp-post-image\" alt=\"123rf_Wawrzyniec Korona\" title=\"Miners\u2019 union seeking court guarantee for Dominion Diamond to meet pension obligations\"> <\/div>\n<\/p><\/div>\n<p class=\"byline\"> <span>Kelsey Rolfe<\/span>&nbsp;|&nbsp;May 11, 2020 <\/p>\n<p>The union representing 400 Dominion Diamond Mines employees is attempting to guarantee that the company honours its multi-million dollar pension shortfall as it goes through a court-ordered creditor protection process.<\/p>\n<p>If the shortfall isn\u2019t prioritized, the Union of Northern Workers said it\u2019s concerned that active members and pensioners would all face reduced pensions. \u201cHow much that would affect those pensioners and the current participants is not known, and would have to go through the court process to wind up and assign those assets,\u201d says union president Todd Parsons.<\/p>\n<p><strong>Read:&nbsp;<a class=\"l lLrAF\" href=\"https:\/\/www.benefitscanada.com\/news\/will-new-changes-to-federal-insolvency-laws-protect-retirees-138224\">Will new changes to federal&nbsp;insolvency&nbsp;laws protect retirees?<\/a><\/strong><\/p>\n<p>He&nbsp;said the union is attending all of Dominion Diamond\u2019s court hearings to advocate for its members. \u201cThe union will take the position [that] the pension earnings should be a priority before creditors are considered, in the event that this company is unable to succeed.\u201d<\/p>\n<p>According to its most recent valuation, Dominion Diamond\u2019s defined benefit pension plan had $90.3 million in assets and a $99.5-million windup liability&nbsp;as of Jan. 1, 2019, leaving the company with a roughly $9-million shortfall.<\/p>\n<p>However, according to a sworn affidavit by Kristal Kaye, Dominion Diamond\u2019s chief financial officer, the deficit had risen to $20.3 million as of Dec. 31, 2019, with its obligations sitting at $111.6 million and its assets at $91.2 million.
